remain the property of the Ministerio de Vivienda, hereafter referred
to as The Ministry of Housing, Paseo de la Castellana, 112, 28071
Madrid, Spain (telephone: 0034 91 728 4004).
USER
CONDITIONS
The
Ministry of Housing advises the User that access and usage of the
www.mviv.es and www.vivienda.es websites, in addition to all sub-domains
and directories included in each (hereafter referred to as the Portal),
together with any services and all content obtained by the User,
are subject to the terms and conditions specified in this Legal
Disclaimer, not precluding access to such services or content that
may be allowed by means of acceptance of the General Conditions.
Accordingly,
in the case of the User not consenting to the conditions mentioned
in this Legal Disclaimer the User is requested to refrain from using
the Portal, given that any such use will confirm acceptance of the
conditions herein.
The
Ministry of Housing, with the purpose of updating, correcting, modifying,
adding to or deleting any of the Portal content and / or its design,
reserves the right to make any changes or adjustments to the Portal
without prior notification. The content and service offered by the
Portal are updated periodically; owing to the fact that information
updates are not immediate, it is advised that the User always verify
the accuracy and validity of the information, services and content
included in the Portal, with particular reference to the activities
of the Regional Governments of Spain, along with City and Town Councils
and other Local Authorities.
Given
that the conditions and terms included in this Legal Disclaimer
can vary, it is suggested that the User study any such terms each
time the Portal is accessed. The Ministry of Housing is not held
responsible for any damage that could be caused by the tools and
information included in the Portal in relation to decision-making
with regard to the initiation, development or result of administrative
proceedings. Such decisions shall be verified in the respective
bodies, departments or organisations. In any event, the information
and content of the Portal may not be used in a conflicting process
with the Public Administration, with no responsibility assumed for
discrepancies that could exist between Public Administration hard
copies and electronically published web content.
INDUSTRIAL
AND INTELLECTUAL PROPERTY RIGHTS
The
Portal design and font codes, in addition to the logos, trademarks
and other distinctive signs that appear therein, remain property
of The Ministry of Housing and / or collaborating entities, being
protected by the corresponding intellectual and industrial property
rights. Likewise, the corresponding intellectual and industrial
property rights also cover the images and content of The Ministry
of Housing server.
The
reproduction, distribution, public communication, or alteration
to content (or any other analogous or similar activity), are prohibited
unless specifically authorised by The Ministry of Housing. Permission
to use the Portal content is limited to the downloading and private
use of said content by the User, on condition that the aforementioned
content remains unabridged.
The
Ministry of Housing declares its recognition of intellectual and
industrial property rights to third parties; consequently, in the
case of the Portal being considered to have infringed such rights,
it is requested that The Ministry of Housing be contacted.
LINKS
The
Ministry of Housing has provided access to other websites that are
considered to be of use. The objective of these links is solely
to facilitate the search for resources on the Internet that could
be of interest. Nevertheless, The Ministry of Housing neither owns
nor reviews the content of such sites; consequently, it cannot be
held generally responsible for the website in question, or for its
functioning, or for the possible damage that could derive from any
access to or use of such a site.
Linking
to the Portal by any other website or electronic mail address is
not permitted, with the exception of specific authorisation being
given in writing by The Ministry of Housing. Furthermore, in the
case of having received such authorisation, web sites that wish
to link to the Portal are requested to respect the following conditions:
(a) that links be restricted to the home page; (b) that the establishment
of such a link shall not signify a legally-binding agreement, contract,
sponsorship or recommendation by The Ministry of Housing of the
web site in question.
The
Ministry of Housing is permitted at any time whatsoever to withdraw
the aforementioned authorisation with no reason being given. In
such a case, the website that has established the link shall delete
it without delay, immediately after receiving notification of the
authorisation withdrawal by The Ministry of Housing.
FRAMES
The
Ministry of Vivienda expressly forbids the carrying out of ‘framings’
and / or use by third parties of any other mechanisms that alter
the design, original configuration or content of the Portal.
APPLICABLE
LAW JURISDICTION
The
applicable law in the case of a dispute or interpretation conflict
of the terms and conditions herein, in addition to any questions
associated with the services of the Portal, will be interpreted
in accordance with Spanish Law.
In
order to reach a settlement of any disagreement that could emerge
from a visit to the Portal or from the use of the services available,
The Ministry of Housing and the User agree to comply with the Law
Courts of the legal residence of the User, provided that said legal
residence falls within the legal jurisdiction of Spain.
